A former employee of PepsiCo, the maker of Lay's chips and Pepsi drinks, sued the company, claiming that management ignored systematic homophobic bullying against her, and then fired her immediately after returning from medical leave. PepsiCo, Inc. — This is one of the largest American multinational corporations in the food industry. The company's product portfolio includes dozens of well-known brands. Among them Pepsi (flagship carbonated drink), Chips Lay’s, 7UP, Mirinda and others.
What is the essence of the charges? The plaintiff (described in court documents as "gay" using female pronouns) claims that she was discriminated against and insulted for two years - from October 2023 to November 2025. According to the lawsuit, she faced a hostile atmosphere from her colleagues:
- Three employees regularly used homophobic insults against her.
- One of her colleagues advised her to speak in a "lower, masculine voice" when communicating with men.
- Two employees openly stated that they were not going to use the same restroom with her.
- Another colleague directly said that he "can't stand such gays" and defiantly took off his protective vest, which the woman regarded as a threat of physical violence.
According to the plaintiff, she repeatedly tried to solve the problem by legal means. She sent complaints to her direct manager, to the human resources department (HR) and even called a special "hotline" of the company. However, the lawsuit alleges that PepsiCo did not take any disciplinary or corrective action to stop the bullying.
The situation escalated in November 2025, when the woman took leave under the Family and Medical Obligations Act (FMLA) to care for her sick husband. While she was on vacation, HR contacted her and told her that one of her colleagues had accused her of harassment — she allegedly touched his cheek or blew a kiss during an October meeting.
The plaintiff categorically denies these accusations. However, on December 30 — just a day after she returned to work — the company notified her of her resignation in an official letter. The reason was "harassment of an employee", which the woman herself calls a "false and far-fetched pretext" for revenge for her complaints and going on medical leave.
The lawsuit alleges that PepsiCo violated Title VII of the Civil Rights Act of 1964, which prohibits discrimination on the basis of sex. In 2020, the U.S. Supreme Court, in a landmark decision in the case Bostock vs. Clayton County confirmed that cases of bias against LGBTQ+ employees also fall under the prohibition of discrimination on the basis of sex.
In addition to discrimination, the company is accused of creating a hostile working environment and unlawfully retaliating an employee who exercised the right to protected medical leave.
