This User Agreement (hereinafter referred to as the "Agreement") is a legally binding agreement between VšĮ “Doberman media”, a legal entity registered in the Register of Legal Entities of the Republic of Lithuania, organization code: 306984317, address: Giedraičių g. 39, R53, LT-09302 Vilnius (hereinafter referred to as the "Administration"), and any individual (hereinafter referred to as the "User") visiting the website doberman.media (hereinafter referred to as the "Site").
1. RESOURCE STATUS AND SUBJECT OF THE AGREEMENT
1.1. Website doberman.media is an independent digital media resource operated by a non-profit organization (VšĮ).
1.2. The Administration provides the User with access to information materials, analytics, multimedia content and services of the Website.
1.3. The Agreement regulates the use of all sections of the Website, including paid functionality for community members.
2. INTELLECTUAL PROPERTY AND CITATION RULES
2.1. All content (texts, exclusive photos, videos, infographics, design and program code) is subject to the exclusive rights of the Administration or its partners.
2.2. Free Use: It is allowed to quote the materials of the Site to the extent justified by the purpose of citation, provided that an active indexed hyperlink to the original on doberman.media is indicated.
2.3. Prohibitions: Full copying of materials (parsing), use of content to train AI models without written permission, as well as commercial use of materials without a contract are prohibited.
3. DISCLAIMER
3.1. Informational nature: The content on the Site is for informational purposes only. The Administration is not responsible for any losses (direct or indirect) arising from the use of information, advice or opinions published on the Website.
3.2. Third-Party Links: The Site may contain links to third-party resources. The Administration has no control over their content and is not responsible for their privacy policies or security.
3.3. Opinions: The opinions of the authors of columns and blogs may not coincide with the position of the Administration.
4. RULES OF CONDUCT AND USER CONTENT
4.1. If there is an opportunity to comment or upload content, the User is prohibited from publishing materials that:
4.1.1. Are illegal, discriminatory, defamatory or incite violence (according to Lithuanian and EU laws).
4.1.2. Violate the copyrights of third parties.
4.1.3. Contain commercial advertising without the consent of the Administration. 4.2. The Administration has the right to delete any user content without giving reasons.
5. PAID MEMBERSHIPS AND PAYMENTS (STRIPE)
5.1. Voluntariness: Paid membership is a form of media resource support. Core content remains available for free.
5.2. Safety: Payment is made through a certified gateway Stripe. The administration does not have access to your card details.
5.3. Subscription: When subscribing, the User agrees to be automatically charged until the moment of cancellation. Cancellations will be made in the Account (personal account) available at https://doberman.media/id.
5.4. Refund Waiver: Since access to digital content is provided instantly, in accordance with EU consumer law, the User confirms the loss of the right to a refund for the current period after gaining access to restricted materials.
6. LIMITATION OF TECHNICAL LIABILITY
6.1. The Administration does not guarantee that the Website will work without errors or viruses. We recommend using up-to-date antivirus software.
6.2. The Administration is not responsible for interruptions in access to the Site associated with the actions of providers, technical services or force majeure (DDoS attacks, accidents on communication lines).
7. DATA PROTECTION (GDPR)
7.1. Data processing is carried out on the basis of Regulation (EU) 2016/679. Details are set out in Privacy Policy.
7.2. Use of the Website means consent to the use of cookies to analyze traffic and improve the performance of the resource.
8. TERMINATION
8.1. The Administration has the right to block the User's access to the Website or paid functionality in case of gross violation of the terms of this Agreement without prior notice.
9. GOVERNING LAW AND DISPUTE RESOLUTION
9.1. This Agreement shall be governed exclusively by the law of of the Republic of Lithuania.
9.2. All disputes are subject to resolution in the courts of the city of VilniusLithuania.
9.3. EU consumers can use the ODR platform for pre-trial dispute resolution: https://ec.europa.eu/consumers/odr.
10. FINAL PROVISIONS
10.1. If any provision of this Agreement is declared invalid by a court, this does not entail the invalidity of the remaining provisions.
